Driver faces murder charge in fatal Charlotte crash

A 31-year-old Charlotte man is in jail Monday, charged with murder and DWI in an overnight two-vehicle crash that killed a 26-year-old woman and left her 4-year-old son fighting for his life.

Charlotte-Mecklenburg police say Eric Jonathan Cox was arrested shortly after the crash, which happened about 2:30 a.m. at East Sugar Creek Road and The Plaza. Investigators say Cox also was speeding and crashed a red light when he slammed into the side of another vehicle.

H'Luon Siu, who was driving the other vehicle, died in the crash. The child, whose name has not been released, is in critical but stable condition at a Charlotte hospital.

According to police, Cox was restricted to no more than .04 blood alcohol level, due to a previous DWI conviction from an arrest in September 2009. They say he was impaired from alcohol use at the time of Monday morning's crash.

Investigators say Cox was driving eastbound on Sugar Creek Road in a 2000 Chevrolet Tahoe and went through a red light at The Plaza. He slammed into the side of a white Nissan being driven by Siu. Cox was charged with second-degree murder, felony serious injury by motor vehicle, DWI, and failure to comply with license restrictions.

Court records show Cox has been charged four previous times in Mecklenburg County. After the September 2009 arrest for DWI and speeding, he was charged in December 2009 with bond violation and resisting a public officer. He also had arrests in 2001 (assaulting an officer) and 2003 (drugs).

The intersection was closed for about four hours but was reopened shortly before daybreak.
