A man accused of driving under the influence of pills and alcohol kicked a York County Sheriff's Office deputy and tried to flee police, according to a sheriff’s report.
Police say 20-year-old Austin Daniel Brandon, of Clover was stopped in the parking lot of a Lake Wylie Food Lion on Wednesday for driving under the influence.
A sheriff’s deputy tried to stop Brandon, the report states, by pursuing him around the grocery store parking lot after the deputy noticed the man who appeared intoxicated while racing the engine of his Ford Mustang.
Brandon failed a field sobriety test and told deputies, “I can’t do it on Adderall,” according to the report.
He also told police, “I’m all spazzed out just like bath salts when I got charged before.”
When a deputy attempted to put handcuffs on Brandon, the report states he jerked away and pushed the deputy, trying to flee.
Another deputy caught the man and police attempted to use a stun gun on Brandon, the report states. Brandon then “tore the Taser leads off his body and attempted to escape,” toward Highway 557, according to the report.
A deputy tackled Brandon again, the report states, which caused them to fall down an embankment.
Deputies attempted to use the stun gun on Brandon a second time, the report states, but he grabbed the device from an officer. Brandon then “struck” and kicked a deputy, police say.
The resistance was a result of Brandon’s “intoxicated state resulting from the consumption of alcohol, his prescribed medicine and possibly Xanax, found in the vehicle he was driving,” the report states.
“He was not feeling the energy of the Taser or the pain of the attempted arm-bars in order to handcuff him behind his back,” the report states.
Brandon had “minor scratches on his shoulder” due to his resisting police, according to the report. One deputy suffered a knee injury during the ordeal.
Brandon is charged with DUI, possession of drugs, underage possession of alcohol and four counts of assaulting a police officer while resisting arrest, according to authorities.
