Burke man convicted of shooting into neighbor’s home

MORGANTON -- A Burke County man has been sentenced to more than five years in prison after being found guilty of shooting into a neighbor’s home more than a year ago.

Daniel Raymond Smart, 44, of Morganton, was convicted in a four-day jury trial this week in Burke County Superior Court.

He was sentenced to between 65 months and 90 months in prison, according to the district attorney’s office.

Authorities allege Smart fired a shot into a neighbor’s house Dec. 27, 2011, in the Smoky Creek community. Prosecutors say the shooting was the result of a dispute between neighbors. They say two adults and two children were in the home at the time. There were no injuries.

Smart faces the same charge -- discharging a weapon into an occupied dwelling -- in Caldwell County, in connection with a 2009 incident. That case is scheduled for trial next Wednesday.
