Carolinas HealthCare appeals Fort Mill hospital decision

Adding another twist to the eight-year battle over who can build a hospital in Fort Mill, Charlotte-based Carolinas HealthCare System has asked for reconsideration of last week’s decision giving the go-ahead to Piedmont Medical Center of Rock Hill.

In 2006, Piedmont Medical got approval from the South Carolina Department of Health and Environmental Control to build in Fort Mill. After appeals, state approval went to Carolinas HealthCare in 2011. Last week, a South Carolina administrative law judge overturned the 2011 decision and gave the OK back to Piedmont Medical, owned by Tenet Healthcare Corp.

On Wednesday, Carolinas HealthCare filed a motion for reconsideration with the South Carolina administrative law court, stating the judge’s recent order was aimed at protecting Piedmont from “perceived adverse effects of competition from an out-of-state hospital.” In doing so, the court “unconstitutionally engaged in economic protectionism,” the motion said.
