Autopsy: Boy had toxic level of pain reliever

CONCORD - Authorities are releasing more information in the case of a 5-year-old boy found dead in his home on Labor Day.

Last week, investigators said that Phillip Lee died from an overdose of methadone. On Tuesday, an autopsy report released stated that Lee also had a toxic level of the pain reliever hydrocodone.

Phillip's mother, Robin Lee, is charged with second-degree murder.

On Sept. 1, investigators found the 5-year-old's body at the family home on Lower Stone Church Road in Cabarrus County.

Police say Phillip's 13-year-old brother, Alex Martinez, wasn't feeling well and called 911 after finding his dead brother. Their mother was unresponsive.

In the medical examiner’s report, Martinez told investigators, "Mom woke me up during the night, told me I had been throwing up and gave me three pills. When I woke up, I felt dizzy but not sick on my stomach."

Martinez said he gave his mother mouth-to-mouth to revive her. They both ended up in the hospital.

Martinez also told investigators that he knew his brother Phillip was dead the moment he touched him.

In the 911 call, Martinez told the operator: "I just woke up and came into my mom's room and she's making a weird noise and I can't wake her up. And my brother is dead."

Robin Lee is being held at the Cabarrus County jail under a $750,000 bond. Her probable cause hearing is scheduled for November 25.
