Duke Energy to appeal judge’s coal-ash ruling

Duke Energy said Thursday that it will appeal a judge’s ruling last month that it take “immediate action” on coal-ash contamination of groundwater.
Duke also asked Superior Court Judge Paul Ridgeway to delay the effect of his ruling during the appeal. Duke argued that, apart from the utilities, industries and municipalities will be affected by his decision.
Ridgeway had overturned a ruling on groundwater contamination by the state Environmental Management Commission. He is also presiding over four state lawsuits against Duke over coal ash. Bruce Henderson
