Q:How do I keep my NY Brokers license, while a resident of NC?
A: You will need to contact NY and ask them their rules about being a non-resident licensee. Each state has different rules.

Q:Hello Mr gallagher I have heard alot about you. I have taken the real estate course and passed the class. I have also taken a cram course before the state exam which i did not pass 3 times.What am i doing wrong? What study habits do you suggest i use to pass this test? It has been awhile since i took the state exam i feel like i might need to take the class again, will the let me sit through class and audit?
A: I'll be glad for you to audit my class. Also, I have 8 audio CD's of 10 hours of review for the state exam. I would recommend that you purchase the CD's from Superior School and review the various topics. Some adult learners find audio is a more effective way for them to learn. Try the audio CD's first. Q:On December 14, 2007, I mailed & gave the tenant 45 days notice to vacant the premises on January 31, 2008. I filed an ejection notice through Small Claims Court. The court date was January 16, 2008. The Tenants did not show up for the court date. The court informed me I had to give them until the January 29, to vacant the premises. I went by the premises to see why they did not appear in court, instead the Tenants were loading a moving truck with there furniture and belonging from the premises. How can I get my back rent although the tenants are gone. I have the employers name/address of both the husband and wife. The November rent was paid half in cash and half in check. The check bounced. December,2007 & January, 2008 is still due. There Dog is still tied in the backyard, but the car is gone. Please advise.
A: You will need to obtain a money judgment from the magistrate in the small claims court.

Q:If my husband and I enter into a lease aggreement and one of us leaves the residence are they still responsible for half of the lease agreement until it is up?
A: If both of you sign the lease, technically, you both are responsible for the entire amount of rent due. The entire amount is due from either one of you and there is "no half" amount.

Q:We contacted the listing agent to look at a home, just browsing. We met with the listing agent who showed us the house and 2 more in the area. We ended up really liking the house she has listed. We have spoke to her a couple times since and she has provided other houses for us to look at. What happens if we want to make a an offer on her listed house? Should we go out and get an agent to represent us? We really like her and like working with her, but will she have our best interest in mind? Also, how will she feel if we go out and get another agent (who will take the buyers commission) after we found the house? Help please.
A: If you feel comfortable working with the agent who has worked with you and you have a rapport created, I would recommend that you continue to work with that agent. If you hire the agent, and the agent is the listing agent on the property, then the agent would be "dual" representing both buyer and seller. I think it's so important that you have an agent you can work with and feel they are helping you.

Q:I am very interested in attending your school for the 75 hour provisional license course. I am looking over dates of classes and plan to sign up by the summer of '08. I was wondering if there would be any literature or books that you would recommend that I could study or read before I start classes. ( or just go ahead and get the text book) Also, I read a past question and saw that you mentioned there may be night classes in the future available. Any more info on that? A: Hello! I would recommend that you go ahead and obtain the textbook for this course and begin reading the chapters. Each chapter has a vocabulary list at the beginning for you to use as a study aid to make sure you know those definitions. Also, we have vocabulary flash cards to him you retain the information. If you feel you will need additional assistance with math, chapter 20 in the textbook is devoted to math and we have an additional math book to help students. I'm so glad you are planning ahead and preparing yourself for the class. We'll offer night classes throughout the year as well as weekday and weekend. Let me know if you have additional questions.

Q:I have a tenant who only signed a one year lease, but has occupied the residence about 4 years. He's consistently late, but usually catches up. He's been 2 months behind for a while now, and I'm going to ask him to leave. Since he does not have a lease, how quickly can I have him out? Does this have to go through the court? Thank you for your help.
A: You will need to contact the sheriff's department in the county where the property is located.

Q:I purchased a house 2.5 years ago here in Charlotte so that my father and stepmother would be able to live in it and rent it from me and then in two years purchase it. They have not been able to even despite two extenstions and unfortunately I need to sell it due to financial burden it has become. I have asked them to move out by Jan. 31 so I can put it on the market but they are refusing to move out. I do not have a lease agreement as I did this to help family. How is the best way to evict them at this point. They have not even paid this month rent so I don't know if that makes it any easier.

Q:I purchased a home 2.5 years ago with the agreement that my father and stepmother would purchase it after 2 years. Unfornuately they are not going to be able to do so and because of the financial burden I need to sell the home. But they are now refusing to move from the property. I am unable to keep the home and need to sell it. How do I initate a eviction proceedings if I do not have a lease contract etc.?
A: To begin eviction proceedings, you will need to contact the sheriff's office in the county where the property is located to begin the paperwork.
