State Rep. Cecil Brockman was arrested on Wednesday on multiple charges of sex crimes involving a minor, according to Guilford County jail records.
Brockman was arrested by the State Bureau of Investigation and booked into the county jail in High Point.
He was expected in court on Thursday, but a sheriff’s deputy announced to people assembled in a Greensboro courtroom that the Democratic lawmaker had a medical emergency and was now at a local hospital. His first court appearance instead took place Friday.
Court records show Brockman faces two counts each of taking indecent liberties with a child and statutory sex offense with a minor who is 15 years old or younger. The inmate search website of the Guilford County Sheriff’s Office incorrectly listed a charge of statutory rape against Brockman.
The arresting officer alleged Brockman “did engage in a sexual act” and “did commit and attempt to commit a lewd and lascivious act upon the body” of a 15-year-old juvenile identified by their initials, according to a magistrate’s order filed in the state’s online court portal.
These offenses allegedly took place on Aug. 15 of this year.
The magistrate assigned Brockman’s case did not authorize him for pre-trial release on Thursday, and ordered him not to try to contact the victim or their family.
In an explanation of the decision to deny release ahead of trial, the magistrate said Brockman is a state lawmaker and has “access to abundant resources to aid in his flight from prosecution.”
The magistrate also said Brockman “has made attempts to contact the victim in this case and has gone as far as attempting to locate the juvenile in the hospital and attempting to use his status to gain information on the whereabouts of the victim.”
The order also stated that authorities have “electronic evidence” against Brockman.
Brockman’s bond may only be set by a district court judge, the magistrate ordered on Thursday.
The arrest and charges against Brockman were first reported by WXII-TV on Thursday.
Brockman is currently serving his sixth term in the N.C. House of Representatives. He was first elected in 2014.
Anderson Clayton, chair of the N.C. Democratic Party, said in a social media post that the state party “calls on Representative Brockman to resign effective immediately. The profound seriousness of these criminal charges makes it impossible to represent his community.”
“The allegations against Rep. Brockman are serious and, if true, would disqualify him from public office,” House Minority Leader Robert Reives, a Chatham County Democrat, said in a statement Thursday morning. “This is a developing situation and it is important to let the legal process unfold.”
House Speaker Destin Hall, the top Republican in the lower chamber, also called on Brockman to resign on Thursday, saying the charges against him “are shocking and extremely serious.”
“Given the evidence that’s publicly known, he should resign immediately so these charges do not distract from the work of the North Carolina House,” Hall said in a statement.
