Death penalty sought in case of bodies found in burnt car

Burke County prosecutors will seek the death penalty against a third person charged in the killings of two men whose bodies were found in the trunk of a burnt car in September.

Prosecutors announced in Burke County Superior Court on Tuesday that they will try the case against Scott Devon Hemphill as a capital matter.

Hemphill, 33, of Charlotte, is charged with two counts of murder in the Sept. 17 deaths of Spencer Murray, 29, and Albert Austin, 35, both of Forest City. Their remains were found in a Cadillac Deville on Canoe Creek Way near Morganton.

Two weeks ago, prosecutors said they would seek the death penalty against Morganton residents Icey Chennell Gooden, 26, and Brian Jerome Robinson, 33, in the case.

Authorities have not released a motive in the killings.
