Robbers point gun at 1-year-old, kill man in east Charlotte home invasion, affidavit says
The men who shot and killed a person and injured another on Shamrock Drive Aug. 2 also pointed a gun at a 1-year-old while robbing the home, a court record says.
The affidavit filed in Mecklenburg Superior Court provides new details of how a home invasion and robbery in east Charlotte turned deadly after a family tried to protect themselves.
According to the affidavit, the victims said armed robbers entered the home in the 3500 block of Shamrock Drive. The family inside had no guns, and none were found inside the home.
Two victims tried to barricade themselves inside a bedroom, but the intruders forced their way in, demanding cash and keys to their vehicles.
One of the victims had a machete, and told the home invaders that he called the police. He asked them not to shoot his grandchildren. The warrant said the invaders stole $1,450 in cash from the bedroom, and one of them pointed a gun at the 1-year-old, threatening to kill them.
The victims heard gunshots coming from the living room. One of the victims saw one of the suspects while they were running toward the front door.
“You shot me,” the suspect said while bleeding from his head. The suspects then left the home. One person in the house was dead in the living room. Another person in the house was shot in the neck.
CMPD previously identified Jose Octavio Cruz, 57, as the man who was killed. The police previously announced the arrests of Kevin Jeremy Zetino, 19, and Adilio Cesar Garcia Lemus, 24.
After arriving at the house, officers followed a blood trail and found suspect Zetino lying in the road near the 3200 block of Shamrock Drive, the affidavit said, with a gunshot wound to the side of his head.
Police found Lemus lying in the roadway, where he had been hit by a vehicle. He had a gunshot wound to his left hip. He also had a fractured arm.
Court records did not specify how the two suspects were shot.
Police reviewed surveillance video from a nearby residence and found a gun in the area Lemus was seen walking that was tied to the shooting, the affidavit said.
Zetino and Lemus, both of Charlotte, are charged with murder, attempted murder, armed robbery, conspiracy to commit armed robbery, first degree burglary and assault with a deadly weapon with intent to kill or inflict serious injury.
They were being held without bond allowed in the Mecklenburg County jail, according to court records.
