Fatal shooting in Charlotte came after man ‘stepped up’ to another, records say

A man charged in a March 6 homicide is accused of shooting a 27-year-old man in the head during an argument with a third person in north Charlotte, according to court records.

J.B. James Jones, 37, was charged with murder and possession of a firearm by a felon in the homicide of Luis Fernando Hernandez, according to Charlotte-Mecklenburg police.

A police affidavit filed in court said the homicide occurred at 3:54 p.m. in an area near Amore Store, a business located on Statesville Avenue. Hernandez was found dead just off the roadway behind a burgundy Honda Accord with gunshot wounds to the bridge of his nose and center of the back of his head, the affidavit said.

Police reviewed footage from the store, which showed Jones arriving in a white Ford F-150 and speaking with people . He briefly spoke with Hernandez, the affidavit said.

“After approximately 25 minutes, the suspect takes issue with an unknown male and produces a handgun,” the affidavit said. “The suspect walks around two parked vehicles before firing two volleys of shots.”

The second shot hit Hernandez in the head, the affidavit said. The footage showed Hernandez immediately fell to the ground and Jones ran away and then left in a truck.

Police spoke with witnesses who identified Jones, the affidavit said.

A witness told police that he and Hernandez had been riding around in the witness’ burgundy Honda Accord when he stopped to urinate in trees behind the store. He then heard gunshots and saw Hernandez on the ground, the affidavit said.

Another witness said they saw Jones running away from the scene and getting into a white truck they said was owned by the mother of Jones’ child, the affidavit said. That witness called another person who was present for the shooting who said Jones was “high on pills and shot at another man who stepped up to him,” the affidavit said.

Jones was being held in the Mecklenburg County Jail on no bond.
